3. Eligibility

The Website is intended for persons who have reached the age of majority under the laws of their jurisdiction. By using the Website, you confirm that you meet this requirement.

4. Usage and Restrictions

You may use the Website only for lawful purposes and in accordance with these Terms of Use. We may restrict or block access to the Website for anyone who breaches these Terms of Use.

Search engines, AI search and answer services, AI advertising services and other AI crawlers may access the publicly available content of the Website in accordance with our robots.txt file, solely for the purposes of indexing, displaying, summarising, citing or recommending the Website, BONET and its services, including in AI-generated answers and online advertising, and for training artificial intelligence models used for these purposes. We reserve all other rights to text and data mining under Article 4 of Directive (EU) 2019/790, in particular for creating or selling datasets, developing products or services that compete with BONET, or reproducing or republishing our content.

Any other automated access to or interaction with the Website, in particular by bots, scripts or scrapers that ignore our robots.txt file, is prohibited without our prior written consent. This does not apply to tools operated by BONET or on its behalf, such as website monitoring, cookie scanning, analytics or SEO tools.

Any attempt to bypass technical safeguards, access controls or rate limits, or to interfere with the normal operation, performance or security of the Website, constitutes a material breach of these Terms of Use and may result in immediate blocking of access, without prejudice to any other rights or remedies available to us.

5. Right to Use the Website

We grant you a limited, non-exclusive, non-transferable and revocable right to access and view the Website and its content for your personal or internal business information purposes. This right does not transfer to you any ownership or intellectual property rights in the Website or its content.

Except as expressly permitted by these Terms of Use (including section 4) or by applicable law, you may not copy, reproduce, republish, distribute, modify, sell, sublicense or otherwise commercially exploit any part of the Website or its content.

6. Acceptable Use

You must not misuse the Website, interfere with its operation or security, attempt to access its non-public areas, or use it in a manner that is fraudulent, abusive, harmful or infringes the rights of any third party. You are responsible for the accuracy and lawfulness of any information you submit through the Website's forms.

7. Intellectual Property Rights

All intellectual property rights in the Website and its content, including texts, graphics, logos, design elements, case studies, articles and documentation, belong to bonet.systems, s.r.o. or its licensors. All rights not expressly granted in these Terms of Use are reserved.

You may not create derivative works from, publicly display or commercially exploit any part of the Website or its content without our prior written consent, except to the extent permitted by applicable law.

The names BONET and ssleek, our logos and other brand elements are trademarks or distinctive signs of bonet.systems, s.r.o. Referring to BONET or ssleek by name, for example in articles, reviews, social media posts or business listings, and linking to the Website are permitted.

Any feedback or suggestions you provide regarding the Website may be used by us without restriction or obligation.

8. Information You Submit

When you submit information through the Website, for example via the contact form, the webinar registration form or the newsletter form, you confirm that it is accurate and that you are entitled to provide it. Personal data submitted in this way is processed in accordance with our Privacy Policy (see section 10).

9. Confidentiality

If, in connection with the use of the Website, either party receives information that is identified as confidential or that by its nature ought reasonably to be treated as confidential, it shall keep that information confidential and use it only for the purpose for which it was provided. Disclosure is permitted where required by law, regulation or court order.

This obligation does not apply to information that a) is or becomes publicly available through no breach of these Terms of Use; b) was lawfully known to the receiving party before disclosure; c) is lawfully received from a third party without restriction; or d) is independently developed without reference to the confidential information.

These obligations survive for 3 years after you stop using the Website and, in respect of trade secrets, for as long as they remain protected under applicable law.

10. Data Protection and Privacy

Personal data collected through the Website is processed in accordance with our Privacy Policy (https://bonet.systems/en/privacy-policy/) and applicable data protection law, in particular Regulation (EU) 2016/679 (GDPR). Information about the cookies used on the Website and how to give or withdraw consent is available in our Cookie Policy (https://bonet.systems/en/cookie-policy/).

11. Third-Party Services

The Website uses or links to tools, services and content of third parties, for example analytics tools, embedded content or links to external websites. We do not own or control them and are not responsible for their content, availability, security or data practices. Your use of them is governed by the terms and policies of the relevant third party.

12. Warranties

We warrant that a) we have the legal right to make the Website and the materials on it available in accordance with these Terms of Use; and b) we will not knowingly make available materials that infringe third-party intellectual property rights. These warranties do not extend beyond what is expressly stated in this section.

13. Disclaimer of Warranties

Except for the warranties in section 12, the Website and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all other warranties, express or implied, including warranties of accuracy, completeness, availability, fitness for a particular purpose and error-free operation.

Information on the Website is of a general nature. It does not constitute professional advice or a binding offer to conclude a contract.

14. Limitation of Liability

Nothing in these Terms of Use limits or excludes liability that cannot be limited or excluded under applicable law, including liability for damage caused intentionally or by gross negligence, for death or personal injury, or for fraud.

Subject to the above:

  • we are not liable for damage resulting from reliance on information published on the Website, from its temporary or permanent unavailability, from errors or malware, or from the content of third-party websites linked from it;
  • neither party is liable for loss of profits, revenue, business opportunities or anticipated savings, or for any indirect or consequential loss.

15. Indemnification

You shall compensate BONET for any damage, costs and reasonable legal fees it incurs as a result of your breach of these Terms of Use, including claims brought by third parties, to the extent permitted by applicable law.

Each party shall indemnify the other for direct losses finally awarded by a competent court arising from a third-party claim that the indemnifying party has infringed that third party's intellectual property rights through its breach of these Terms of Use. This applies only if the indemnifying party receives prompt written notice of the claim and a reasonable opportunity to participate in its defence.

This indemnity applies only to the extent permitted by applicable law. It does not apply to consumers or to the extent the claim arises from the indemnified party's own acts or omissions.

16. Termination

We may restrict or terminate your access to the Website if you materially breach these Terms of Use and, where the breach can be remedied, you fail to remedy it within 3 days after being notified. In the case of a serious breach, in particular unauthorised automated access or an attack on the security of the Website, we may block access immediately.

Either party may terminate these Terms of Use for convenience by giving 7 days' notice. You may also do so at any time simply by stopping using the Website. We may change, suspend or discontinue the Website or any part of it at any time.

Termination does not affect rights and obligations that arose before it. Provisions which by their nature are intended to survive termination remain in effect (see section 24).

17. Governing Law

These Terms of Use, and any dispute or claim arising out of or in connection with them, including non-contractual disputes or claims, are governed by the laws of the Slovak Republic. Nothing in this section limits any rights a consumer may have under mandatory law of the country of their habitual residence.

18. Dispute Resolution and Jurisdiction

Any dispute arising out of or in connection with these Terms of Use, including any question regarding their existence, validity or termination, shall be resolved by the competent courts of the Slovak Republic. This does not prevent either party from seeking interim or injunctive relief from any competent court where necessary to protect its rights, nor does it limit a consumer's right to bring proceedings in a court competent under mandatory law.

19. Compliance with Laws

Each party shall comply with all laws and regulations applicable to it in connection with the use and operation of the Website.

20. Force Majeure

Neither party is liable for any failure or delay in performing its obligations under these Terms of Use to the extent caused by events beyond its reasonable control, including natural disasters, war, terrorism, civil unrest, strikes, epidemics, governmental actions, or failures of utilities, hosting providers or telecommunications networks. The affected party shall use reasonable efforts to mitigate the effects of such an event.

21. Assignment

You may not assign or transfer your rights or obligations under these Terms of Use without our prior written consent. We may assign these Terms of Use in connection with a merger, reorganisation, change of control or sale of all or substantially all of our assets.

22. Changes to the Terms of Use

We may update these Terms of Use at any time by publishing the revised version on this page with a new effective date. Changes take effect on the date of publication unless stated otherwise. Continued use of the Website after that date constitutes acceptance of the revised Terms of Use. If you do not agree with the changes, please stop using the Website.

These Terms of Use are published in Slovak and English. In the event of any inconsistency, the Slovak version prevails.

23. Severability

If any provision of these Terms of Use is held invalid, illegal or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable or, if that is not possible, deemed deleted. The remaining provisions remain in full force and effect.

Our failure to enforce any provision of these Terms of Use does not constitute a waiver of that provision or of our right to enforce it later.

24. Survival

Provisions relating to intellectual property, confidentiality, limitation of liability, indemnification, governing law, dispute resolution and jurisdiction survive termination of these Terms of Use.

25. Notices

Notices under these Terms of Use must be in writing and may be delivered personally, sent by post or sent by email. Notices are deemed received:

  • if delivered personally, at the time of delivery;
  • if sent by post, 2 business days after posting;
  • if sent by email, at the time of transmission, unless a delivery failure notice is received.
